Export of fish and seafood for human consumption to China after December 31, 2022

The Canadian Food Inspection Agency (CFIA) has been working with industry for several months to ensure the correct renewal information is entered into China’s Import Food Enterprise Registration (CIFER) system and submitted to the General Administration of Customs of the People’s Republic of China (GACC). However, some establishment renewal applications have not been approved by GACC as of yet.

The CFIA has developed a “Letter of Commercial Risk” for the export of fish and seafood products for human consumption to China after December 31, 2022.

The registration of all fish and seafood establishments in CIFER will expire on December 31, 2022. In accordance with Decrees 248 and 249 and decisions issued by China, it is a GACC requirement that all establishments must possess a valid CIFER registration in order to export fish products to China.

The CFIA has compiled a list of Establishments whose requests for CIFER registration renewal has been submitted to GACC by December 31, and have not yet been approved by GACC; and of the fish and seafood establishments who have a request for modification waiting GACC’s approval in the CIFER system. For establishments contained within this list, the CFIA will require that a Letter of Commercial Risk be completed by the exporter and submitted to the CFIA in order to receive an export certificate.

This letter will release the CFIA of any liability associated with the certification of the Canadian fish product for export to China, and acknowledge that the exporter accepts the full legal liability for the export of their product to China. Businesses that choose to continue to export fish and seafood products to China after December 31, 2022, without approval from GACC in the CIFER system, do so at their own commercial risk.

Procedure:

• When the export certification request form is received by the CFIA, the inspector will consult the “List of Establishments” maintained by the CFIA to ensure the establishment is contained within this list.
• Once the inspector has confirmed that the establishment is identified on the “List of Establishments” they will forward a copy of the “Letter of Commercial Risk” to the exporter, along with the requested certificate template.
• The exporter will be required to complete the letter of commercial risk and return it to CFIA when they submit the completed certificate template “Health Certificate for fishery products intended for export from Canada to the people`s Republic of China (CFIA/ACIA 5328)” for validation.

The export certification of live fish does not require CIFER registration and is not impacted at this time.

L’Agence canadienne d’inspection des aliments (ACIA) travaille avec l’industrie depuis plusieurs mois pour s’assurer que les informations de renouvellement correctes sont saisies dans le système d’enregistrement des entreprises alimentaires d’importation de la Chine (CIFER) et soumises à l’Administration générale des douanes de la République populaire de Chine (GACC ). Cependant, certaines demandes de renouvellement d’établissement n’ont pas encore été approuvées par GACC.

L’ACIA a élaboré une «Lettre de risque commercial» pour l’exportation de poissons et de fruit de mer destinés à la consommation humaine vers la Chine après le 31 décembre 2022.

L’enregistrement de tous les établissements de poissons et de fruit de mer dans CIFER expireront le 31 décembre 2022. Selon les décrets 248 et 249 ainsi que les décisions émis par la Chine, c’est une exigence de GACC que tous les établissements doivent posséder un enregistrement valide dans CIFER afin d’exporter des produits de poisson vers la Chine.

L’ACIA a développé une liste d’établissements dont les demandes de renouvellement d’enregistrement dans CIFER ont été soumises à GACC avant le 31 décembre et qui n’ont pas encore été approuvées par GACC et des établissements de poissons et de fruit de mer qui ont une demande de modification en attente d’approbation par GACC dans le système CIFER. Pour les établissements inclus dans cette liste, l’ACIA exigera une lettre de risque commercial compléter par l’exportateur et soumis à l’ACIA afin de recevoir un certificat d’exportation.

Cette lettre dégagera l’ACIA de toute responsabilité associée à la certification de son produit de poisson canadien pour l’exportation vers la Chine et reconnaîtra que l’exportateur accepte l’entière responsabilité légale pour l’exportation de son produit vers la Chine. Les compagnies qui décides d’exporter du poissons et des fruit de mer vers la Chine après le 31 décembre 2022, sans l’approbation de GACC dans le system CIFER, le font à leur propre risque commerciale.

Procédure:

• Lorsque l’ACIA reçoit le formulaire de demande de certification d’exportation, l’inspecteur consulte la «Liste d’établissements» maintenue par l’ACIA pour s’assurer que l’exportateur figure sur cette liste.
• Une fois que l’inspecteur a confirmé que l’établissement est identifié sur la «Liste des établissements», il transmet une copie de la «Lettre de risque commercial» à l’exportateur, ainsi que le modèle de certificat demandé.
• L’exportateur devra remplir la «Lettre de risque commercial» et la retourner à l’ACIA lorsqu’il soumettra le modèle de certificat «Certificat sanitaire pour les produits de la pêche destinés à l’exportation du Canada vers la République populaire de Chine (CFIA/ACIA 5328)» rempli pour validation.

La certification d’exportation de poissons vivants ne nécessite pas d’enregistrement dans CIFER et n’est pas impactée pour le moment.
