Products Containing Mercury

Environment and Climate Change Canada (ECCC) administers the Products Containing Mercury Regulations. The Regulations broadly prohibit the import or manufacture of products containing mercury, or any of its compounds, with some exemptions. It is the responsibility of Canadian importers and manufacturers to determine whether the Regulations apply to them and to ensure that the products manufactured or imported respect the requirements of the Regulations. As set out in section 12 of the Regulations, imports and manufacture of exempted or permitted products containing mercury must be reported on or before March 31, 2020.

Reports must be submitting via the Products Containing Mercury Regulations online reporting system (PCMR). Reporting is required every three years.

In addition to reporting, other regulatory requirements such as labelling and record keeping may also apply. You must keep records and supporting documentation for every activity on file for a period of at least five years. Comprehensive guidance material and the full text of the Regulations can be found on the website http://canada.ca/mercury-products, including a new tool called “5 Steps for Easy Reporting” which addresses some of the most frequently asked questions during the reporting process (see 'Reporting system guidance material').

Exports of mercury and products containing mercury are controlled under the Export of Substances on the Export Control List Regulations. For more information, please consult the guidance document for exporters at: http://canada.ca/export-controlled-substance.
